Digital assets in Kenya are taxed at the rate of 3% upon each transfer or exchange. Not on gains. This tax is collected and remitted to Kenya Revenue Authority by the platform owner or the person facilitating the transfer.

The tax must then be remitted to KRA within five working days after the withholding.

In addition, the platform owner or facilitator must file a return detailing the amount of payment, tax deducted and any other details required by KRA. A non-resident owner of a digital platform where digital assets are transferred or exchanged must register under the simplified tax regime.
